Once again! Regarding Notice of Motion 14, A Motion to Revise Canon 35

 

To Members of Synod

 

Appeals were made to the Chancellor, John Arnold, regarding the validity of Notice of Motion #14, A Motion to Revise Canon 35.

 

The Chancellor has concluded that Notice of Motion #14 may be considered by synod and does not require a motion of consent.

 

A summary of the Chancellor’s judgment is as follows.

 

For a motion to be considered by synod two requirements must be met according to Section 28 (b) of the Constitution of Synod.  First, it must be sent to the Executive Secretary of Synod (not received but sent) at least three months before the meeting.  Although the timing is very tight, in my opinion that time limit was met, even though it was sent a few hours after the published deadline.  Had it been sent on July 13, it would have been too late. 

 

The second requirement is that it must be published in the convening circular.  That happened.  The fact that delegates were told that a motion of consent would be needed because it was late being received does not significantly affect the substance of the reason for the requirement, in my view.  Members of synod still have the notice of the intent of the motion and can reflect on its merits.

 

But please note also:

 

In addition and regrettably, when Notice of Motion #14 was printed in the convening circular, one page was omitted and another page was transposed into Notice of Motion #15.  The Synod office apologizes for this.  These errors were duplicated also on the website.

 

Notice of Motion #14 has been corrected on our website and a copy of the correct motion will be projected on the screen at synod at the time of presentation and discussion.
